Terms of Service

1. Acceptance of Terms
By accessing and using NovaPhono Entia Culinary Studio's services, including but not limited to booking cooking classes, purchasing meal kits, or participating in any culinary experiences, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, you may not use our services.
2. Booking and Reservations
All bookings for culinary experiences require full payment at the time of reservation. We accept various payment methods including credit cards, debit cards, and electronic transfers. Your reservation is confirmed only upon receipt of full payment and confirmation email from our team.
Participants must arrive at least 15 minutes before the scheduled start time. Late arrivals may not be permitted to join the session and will not be eligible for refunds.
3. Cancellation and Refund Policy
We understand that plans may change. Our cancellation policy is designed to be fair to both our customers and our culinary team:
- Cancellations made 72 hours or more before the scheduled experience: Full refund
- Cancellations made 24-72 hours before the scheduled experience: 50% refund
- Cancellations made less than 24 hours before the scheduled experience: No refund
- No-shows: No refund
- Rescheduling requests made 48+ hours in advance: No fee
- Rescheduling requests made less than 48 hours in advance: 25% rescheduling fee
In exceptional circumstances, we may make exceptions to this policy at our discretion.
4. Participant Requirements and Safety
All participants must adhere to the following safety requirements:
- Wear appropriate closed-toe shoes in the kitchen
- Tie back long hair during food preparation
- Follow all instructions from culinary instructors
- Disclose any food allergies or dietary restrictions during booking
- Inform instructors of any medical conditions that may affect participation
- Use equipment only as instructed
- Maintain clean and sanitary workspace
We reserve the right to refuse participation to anyone who appears intoxicated, under the influence of substances, or behaves in a manner that may endanger themselves or others.
5. Age Restrictions
Our culinary experiences have the following age requirements:
- Adult classes: 18 years and older
- Teen classes (16-17 years): Parental consent required
- Family classes: Children 12+ accompanied by adult
- Kids classes (8-11 years): Specific children's programming only
- Private events: Age requirements vary by event type
Valid government-issued ID may be required for age verification.
6. Intellectual Property
All recipes, cooking techniques, presentation methods, and instructional materials provided during NovaPhono Entia experiences are the intellectual property of NovaPhono Entia Culinary Studio. Participants may use these materials for personal, non-commercial purposes but may not:
- Reproduce or distribute recipes for commercial purposes
- Teach classes based on our proprietary content
- Record sessions without prior written permission
- Use our branding or name without authorization
- Claim our recipes or techniques as their own
7. Liability and Assumption of Risk
Participation in culinary activities involves inherent risks including but not limited to cuts, burns, slips, falls, and allergic reactions. By participating in our experiences, you acknowledge and assume these risks. NovaPhono Entia maintains comprehensive liability insurance, but our liability is limited to the extent permitted by law.
We are not liable for any personal items lost, stolen, or damaged during your visit to our studio.
8. Dietary Restrictions and Allergies
While we make every effort to accommodate dietary restrictions and allergies, we cannot guarantee completely allergen-free environments due to shared kitchen spaces and equipment. Participants with severe allergies must:
- Disclose all allergies during booking
- Bring necessary medications (epinephrine auto-injectors, etc.)
- Consult with our team about specific concerns
- Understand that cross-contamination is possible
- Make informed decisions about participation
9. Photography and Media Release
During our culinary experiences, we may take photographs or video recordings for promotional purposes. By participating, you grant NovaPhono Entia the right to use your likeness in marketing materials, social media, and on our website. If you prefer not to be photographed, please inform our staff at the beginning of your session.
10. Gift Certificates and Vouchers
Gift certificates and promotional vouchers are subject to the following terms:
- Valid for 12 months from purchase date
- Non-refundable and not redeemable for cash
- Subject to class availability
- Must be presented at time of booking
- May not be combined with other promotions
- Lost or stolen certificates will not be replaced
11. Force Majeure
NovaPhono Entia shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, government restrictions, pandemics, strikes, utility failures, or other major disruptive events. In such cases, we will make reasonable efforts to reschedule your experience or provide credit for future use.
12. Governing Law and Dispute Resolution
These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Toronto, Ontario.
13. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes constitutes your acceptance of the new terms. We will make reasonable efforts to notify users of significant changes.
